Please read these Terms carefully
DoctorAI is not a doctor, and it is not a medical device. It provides general health information generated by artificial intelligence. It does not diagnose, treat, cure or prevent any disease or condition, and its answers can be incomplete or wrong. Do not use DoctorAI in an emergency. If you think you may have a medical emergency, call your local emergency number immediately.
These Terms include limitations of our liability (Clauses 17 and 18) and set out how disputes are resolved (Clause 20). Nothing in these Terms affects rights you have as a consumer that cannot be waived under the law that applies to you.
1. Who we are and how to contact us
1.1 DoctorAI (the "App") and the website at assistlyai.space (the "Website") are provided by the individual developer who operates under the trade name Assistly AI ("Assistly AI", "we", "us" or "our"). The App, the Website and every feature, answer and service made available through them are together the "Service".
1.2 You can contact us about anything in these Terms, including complaints, legal notices and requests to delete your account, by email at karadumanburak000@gmail.com. To help us find your account, please include the Support ID shown in the App under Settings, then Account.
2. These Terms and when they apply
2.1 These Terms of Service (the "Terms") form a legally binding agreement between you and Assistly AI. They apply whenever you download, open or use the Service, whether or not you have created a registered account.
2.2 Our Privacy Policy explains how we collect and use personal information, including health information you choose to share. It forms part of these Terms. Our Cookie Policy also applies.
2.3 By using the Service you confirm that you have read, understood and accept these Terms. If you do not accept them, you must not use the Service.
3. Important medical information
3.1 Information, not medical advice. The Service provides general health and medical information for educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis or treatment, and it must not be used as the sole basis for any decision about your health or anyone else's.
3.2 Not a medical device. DoctorAI is not a medical device and has not been cleared, approved or certified as one by any regulator. It does not diagnose, treat, cure, mitigate or prevent any disease or condition.
3.3 No doctor-patient relationship. Using the Service does not create a doctor-patient relationship, or any other professional relationship, between you and Assistly AI or anyone else. No physician reviews your questions or the answers you receive.
3.4 Emergencies. The Service is not designed for and must not be used in emergencies. If you or someone else may be in danger, have severe or rapidly worsening symptoms, or are thinking about self-harm, contact your local emergency number or go to the nearest emergency department at once. Never delay seeking care, and never disregard professional advice, because of something you read in the Service.
3.5 Medicines and treatment. Do not start, stop or change any medicine, dose or treatment on the strength of an answer from the Service. Speak to a doctor or pharmacist first.
3.6 Photos, lab reports and scans. When you share a photo, lab report or imaging report, the Service can describe what it observes and what findings commonly mean. It cannot examine you, it may misread an image or document, and a photo or report alone is not enough to reach a diagnosis. Have any concern checked in person by a qualified professional.
4. Who may use the Service
4.1 You may use the Service if you are at least 18 years old, or have reached the age of majority where you live if that is higher, and are able to enter into a binding contract.
4.2 A person under that age (a "Minor") may use the Service only with the consent of a parent or legal guardian, who accepts these Terms on the Minor's behalf and remains responsible for the Minor's use of the Service, including any purchases. We strongly recommend that a parent or guardian supervises any use by a Minor, and that health questions about a child are asked by the parent or guardian. Our Privacy Policy explains how we handle information about Minors.
4.3 You must not use the Service where doing so is prohibited by the law that applies to you.
5. Your account
5.1 Automatic account. When you first open the App, we create an anonymous account for your installation so that your credits and any subscription can be recorded. You do not need to give us your name or email address to use the Service. Where the App offers it, you may link your account to a Google account so that it can be recovered on another device.
5.2 Your conversations. Your conversations, reminders and profile details (such as your name and role) are stored on your device. They are not backed up by us. If you delete a conversation, delete the App, reset your device or lose it, that content may be lost permanently and we will not be able to restore it.
5.3 Security. You are responsible for keeping your device and any linked sign-in method secure, and for all activity under your account. Tell us promptly if you believe your account has been used without your permission.
5.4 One person, one account. Accounts are personal. You must not sell, transfer or share your account, or create multiple accounts in order to obtain additional free credits or otherwise get around the limits of the Service.
5.5 Inactive anonymous accounts. An anonymous account that has never held a subscription is deleted automatically after 90 days without any activity. Any unused credits on it are lost.
6. How DoctorAI works
6.1 You are talking to an AI. Answers in the Service are generated by artificial intelligence systems, including large language models supplied by third-party providers such as OpenAI. They are not written or reviewed by a human. The optional natural read-aloud voices available to subscribers are synthetic, AI-generated voices.
6.2 Sources. Before answering, the Service searches a reference library of medical textbooks and, for clinical questions, published research indexed by PubMed, and it lists the references it drew on beneath the answer. A listed reference shows what the answer was grounded in. It does not mean that the reference's authors or publishers endorse the answer, that the reference supports every statement in it, or that the reference is complete or current. Read the original source before relying on it.
6.3 Limitations. AI-generated answers can be inaccurate, incomplete, out of date, inconsistent or inappropriate for your circumstances, even when they sound confident and cite sources. The Service only knows what you tell it, cannot verify it, and does not have your medical history. You are responsible for evaluating every answer, including by checking it with a qualified professional, before acting on it.
6.4 Processing your inputs. To answer you, the text, photos, documents and voice recordings you submit are sent to our servers and to our service providers, including our AI providers, for processing. Text recognition from an image ("Extract text") and, unless you turn on clinical dictation, speech-to-text take place on your device. Our Privacy Policy describes this in more detail.
7. Credits
7.1 How credits work. Sending a message uses credits ("Credits"). At the date of these Terms, a message without attachments uses 1 Credit and a message with a photo or PDF uses 2 Credits. You may attach up to 4 files to a message: JPEG or PNG images of up to 10 MB each, and PDF documents of up to 20 MB each.
7.2 Daily allowance. Once each day, at 00:00 Coordinated Universal Time (UTC), your balance is topped up to your daily allowance: 5 Credits on the free plan and 100 Credits while you hold an active subscription. A top-up never reduces a higher balance, and unused Credits do not accumulate beyond your allowance. A new account on a device that has not received Credits before starts with 5 Credits.
7.3 Free access window. Where the App offers it, you may open a free access window once every 30 days, during which messages do not use Credits for 10 minutes. It is a goodwill feature and is not an emergency service (see Clause 3.4).
7.4 Nature of Credits. Credits are a measure of how much of the Service you may use. They have no monetary value, cannot be bought, sold, transferred or exchanged for cash, and are not refundable. We may also grant Credits through promotions or referral offers, on the terms stated in the offer.
7.5 Changes and fair use. We may change Credit costs, daily allowances and file limits, for example to reflect the cost of providing the Service. If a change reduces what an active subscription includes, we will give you reasonable advance notice, and the change will apply from your next renewal so that you can cancel before it takes effect. We may apply rate limits and other technical measures to protect the Service from abuse.
8. Premium subscriptions
8.1 Plans. DoctorAI Premium (a "Subscription") is offered as a weekly, monthly or yearly plan. It currently includes a daily allowance of 100 Credits and natural AI read-aloud voices, in addition to everything on the free plan. The features, price and billing period of each plan are shown in the App before you buy. If an offer includes a free trial or an introductory price, its length and the price that applies afterwards are also shown before you confirm.
8.2 Purchase through the app store. Subscriptions are sold and billed through Google Play or, where available, the Apple App Store (each an "App Store"), using the payment method held by that App Store. The App Store's own terms also apply to your purchase.
8.3 Automatic renewal. Your Subscription renews automatically at the end of each billing period, and you will be charged the then-current price for the same period, until you cancel. To avoid being charged for the next period, cancel at least 24 hours before the current period ends.
8.4 How to cancel. You can cancel at any time in your App Store account: on Android, in Google Play under Payments and subscriptions, then Subscriptions; on iPhone, in Settings, then your name, then Subscriptions. Deleting the App or your account does not cancel a Subscription. After you cancel, your Subscription stays active until the end of the period you have paid for, and your account then returns to the free plan.
8.5 Refunds. Because payments are collected by the App Store, refund requests are handled under its refund policies: for Google Play, see the Google Play refund policies, and for the App Store, request a refund from Apple. Except as stated in this Clause or required by law, payments are not refundable and we do not give credit for partially used periods.
8.6 Right of withdrawal. A Subscription is a digital service that begins as soon as your purchase is confirmed. To the extent permitted by the law that applies to you, by confirming the purchase you request that performance begins immediately and you acknowledge that any statutory right of withdrawal may be limited or lost once the Service has been provided. Where the law gives you a right of withdrawal that cannot be excluded in this way, you may exercise it through the App Store or by contacting us under Clause 1.2.
8.7 Price changes. We may change Subscription prices. The App Store will notify you of any increase in advance, in accordance with its procedures, and where required will ask for your consent before the new price applies. If you do not agree to an increase, you may cancel before it takes effect.
8.8 Restoring purchases. If you reinstall the App or move to a new device, you can restore an active Subscription with the "Restore purchases" option in the App, using the same App Store account.
9. Your content and AI output
9.1 Your content. You keep ownership of the questions, photos, documents and recordings you submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and analyse Your Content, and to share it with our service providers, only as needed to provide, secure and maintain the Service and as described in our Privacy Policy.
9.2 Your responsibility. You confirm that you have all rights and permissions needed to submit Your Content, and that submitting it does not breach any law or anyone else's rights. Do not submit information about another identifiable person, including photos or medical records, unless you are legally entitled to do so and, where required, have their consent.
9.3 Output. As between you and us, you may use the answers the Service generates for you ("Output") for any lawful purpose, subject to these Terms. Because of how AI works, other users may receive similar Output. We make no promise that Output is accurate, original or free of third-party rights, and you are responsible for how you use it.
9.4 Feedback. If you send us suggestions or feedback, we may use them without restriction or payment to you.
10. Use by healthcare professionals and students
10.1 Clinicians. If you are a healthcare professional, the Service is a reference and learning aid only. It is not clinical decision support software and must not replace your independent professional judgement, applicable clinical guidelines or the policies of your institution. You alone are responsible for your diagnoses, treatment decisions and the care you provide.
10.2 Patient information. You must not submit information that identifies a patient, including names, identification numbers, dates of birth, or identifiable images or records, unless you have a lawful basis and any consent required by law and your professional obligations. We do not act as your data processor, business associate or similar under health-data legislation, and we do not sign agreements in that capacity.
10.3 Exam preparation. USMLE practice questions and explanations are generated for study purposes. They are not official examination material and may not reflect the content, format or difficulty of any examination. DoctorAI is not affiliated with, endorsed by or sponsored by the United States Medical Licensing Examination program, the Federation of State Medical Boards (FSMB) or the National Board of Medical Examiners (NBME). USMLE® is a registered trademark of the FSMB and NBME.
11. Acceptable use
11.1 You must use the Service lawfully and responsibly. In particular, you must not:
- use the Service to harm yourself or others, or to obtain instructions for causing harm, including help with self-harm, the misuse of medicines or controlled substances, or the creation of weapons or poisons;
- submit sexually explicit material, or any image that sexualises or exploits a child;
- submit content that is unlawful, defamatory or harassing, or that infringes anyone's privacy, intellectual property or other rights;
- present Output as advice from a doctor or other qualified professional, or use the Service to provide medical services to others;
- copy, scrape, resell or commercially exploit the Service or its Output in bulk, or use them to build or train a competing product or AI model;
- reverse engineer, decompile or attempt to extract the source code, prompts, models or reference library of the Service, except where the law expressly allows it;
- circumvent or interfere with Credits, rate limits, security or other technical measures, including by creating multiple accounts, altering device identifiers or automating requests;
- introduce malware, overload the Service or attempt to gain unauthorised access to any system or account; or
- use the Service in breach of the usage policies of our AI providers, or of any applicable law.
11.2 We may decline to answer requests that we reasonably believe breach this Clause, and we may take the action described in Clause 16.
12. Reminders and device features
12.1 Reminders are notes that you create and schedule on your device. They are not medical alerts and are not generated or monitored by us. Delivery depends on your device's settings, battery management and notification permissions, and a reminder may be delayed or not shown at all. Do not rely on the Service to remind you to take medicine or attend to anything time-critical.
12.2 Some features ask for access to your camera, photos, microphone or notifications. You can grant or withdraw these permissions at any time in your device settings, but the related features will not work without them.
13. Third-party services, sources and links
13.1 The Service relies on third parties, including App Stores, our AI providers, and providers of hosting, sign-in, subscription management and crash reporting. Their services are outside our control and may be subject to their own terms.
13.2 References and links in answers may lead to third-party websites and publications, such as PubMed. We do not control, endorse or take responsibility for third-party content, and your use of it is governed by the third party's own terms.
14. Intellectual property
14.1 The Service, including its software, design, text, graphics, the DoctorAI name and logo, and the compilation of its reference library, belongs to us or our licensors and is protected by intellectual property laws. Third-party works referred to in the Service remain the property of their respective owners.
14.2 Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive and non-transferable licence to install and use the App on devices you own or control, and to use the Service, for your own personal, educational or professional reference purposes. No other right is granted to you.
15. Availability and changes to the Service
15.1 We work to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, timely, secure or error-free, or available in every country or language. The Service may be unavailable during maintenance or because of events beyond our reasonable control.
15.2 We may change, add or remove features, AI models, sources and providers from time to time. If a change materially reduces the features of a Subscription you have paid for, we will tell you in advance, and you may cancel it. If we discontinue the Service entirely, we will give you reasonable notice where we can.
16. Suspension, termination and deleting your account
16.1 Your right to stop. You may stop using the Service at any time. You can ask us to delete your account by using the account deletion option in the App, where available, or by emailing us under Clause 1.2 with your Support ID. Deleting your account removes your account and Credits from our systems as described in our Privacy Policy and the account deletion page. It does not cancel an App Store Subscription (see Clause 8.4), and it does not remove conversations stored on your device; delete the App to remove those.
16.2 Our right to suspend or end your access. We may suspend or terminate your access to the Service, or remove Credits obtained improperly, if you materially breach these Terms, if your use creates a risk of harm to you, others or the Service, or if we are required to do so by law. Where it is reasonable and lawful to do so, we will tell you why and give you an opportunity to respond. If we end your access without cause, we will refund any prepaid Subscription fees for the unused period where the law requires it.
16.3 Clauses 3, 9, 14, 17, 18, 19, 20 and 23, and any other terms that by their nature are meant to continue, survive the end of these Terms.
17. Disclaimers
17.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE MAKE NO WARRANTY, REPRESENTATION OR GUARANTEE, WHETHER EXPRESS, IMPLIED OR STATUTORY, THAT THE SERVICE OR ANY OUTPUT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, SAFE, FIT FOR A PARTICULAR PURPOSE OR SUITABLE FOR YOUR CIRCUMSTANCES, AND WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
17.2 ANY RELIANCE YOU PLACE ON THE SERVICE OR ON ANY OUTPUT IS AT YOUR OWN RISK. THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE, AND NO ANSWER SHOULD BE TREATED AS A DIAGNOSIS OR AS A RECOMMENDATION OF ANY TREATMENT.
17.3 Some jurisdictions do not allow certain warranties to be excluded. In those jurisdictions, this Clause applies only to the extent the law allows, and nothing in it limits the statutory rights you have as a consumer, including in relation to defective services.
18. Limitation of liability
18.1 What we do not exclude. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for loss caused by our intent or gross negligence, or for any other liability that cannot be excluded or limited under applicable law, including Article 115 of the Turkish Code of Obligations (Law No. 6098).
18.2 SUBJECT TO CLAUSE 18.1 AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE LOSS, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, ANY OUTPUT OR THESE TERMS, OR FOR ANY LOSS ARISING FROM DECISIONS YOU OR OTHERS MAKE IN RELIANCE ON OUTPUT CONTRARY TO CLAUSES 3 AND 10.
18.3 SUBJECT TO CLAUSE 18.1, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY UNITED STATES DOLLARS (USD 50) OR ITS EQUIVALENT IN YOUR LOCAL CURRENCY.
19. Indemnity
19.1 To the extent permitted by applicable law, and except where you use the Service as a consumer in a jurisdiction that does not permit such an obligation, you agree to compensate us for reasonable losses, costs and expenses (including reasonable legal fees) arising from claims by third parties that result from your breach of these Terms, Your Content, or your use of Output in providing services to others.
20. Governing law and disputes
20.1 Talk to us first. If you have a complaint, please contact us under Clause 1.2 so that we can try to resolve it. We aim to respond within 30 days.
20.2 Governing law. These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules.
20.3 Courts. Subject to Clauses 20.4 and 20.5, the courts and enforcement offices of Istanbul (Central), Türkiye, have jurisdiction over any such dispute.
20.4 Consumers in Türkiye. If you are a consumer, nothing in these Terms limits your rights under the Law on Consumer Protection (Law No. 6502) and its implementing regulations. Depending on the value of the dispute, you may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti), or bring proceedings, subject to any mandatory mediation, before the Consumer Court (Tüketici Mahkemesi), in each case in the place where you are domiciled or where the transaction took place, within the monetary limits announced each year.
20.5 Consumers elsewhere. If you are a consumer resident outside Türkiye, the choice of Turkish law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of that country where its law allows. Consumers in the European Union may also use the alternative dispute resolution bodies available in their country.
21. App Store terms
21.1 Google Play. If you downloaded the App from Google Play, your use of Google Play is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content.
21.2 Apple. If you downloaded the App from the Apple App Store, you and we acknowledge that:
- these Terms are between you and us only, not with Apple Inc. ("Apple"), and we, not Apple, are solely responsible for the App and its content;
- your licence to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation;
- in the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim;
- you represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties;
- you must comply with any applicable third-party terms when using the App; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right to enforce them against you as a third-party beneficiary.
22. Changes to these Terms
22.1 We may update these Terms from time to time, for example to reflect changes to the Service or to the law. We will post the updated Terms on this page and change the "Last updated" date. If a change is material, we will give you reasonable notice before it takes effect, normally at least 15 days, through the App or another appropriate means.
22.2 If you continue to use the Service after a change takes effect, the updated Terms apply to you. If you do not agree to a change, you must stop using the Service and, if you have a Subscription, cancel it before its next renewal.
23. General
23.1 Entire agreement. These Terms, together with the Privacy Policy, the Cookie Policy and the terms shown to you at the point of purchase, are the entire agreement between you and us about the Service.
23.2 Severability. If a court or authority finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force.
23.3 No waiver. If we do not enforce a right under these Terms straight away, we have not waived it and may still enforce it later.
23.4 Transfer. We may transfer our rights and obligations under these Terms to another person or organisation, for example if the Service is sold, provided that this does not reduce your rights. You may not transfer your rights or obligations under these Terms without our written consent.
23.5 Events outside our control. We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including outages of our providers or of the App Stores.
23.6 Notices. We may give you notices through the App, on the Website or, if you have given us one, by email. You may give us notices by email under Clause 1.2.
23.7 Language. These Terms are written in English. If we provide a translation, the English version prevails in the event of any inconsistency, except where the law that applies to you requires otherwise.
